Terms of Service
These Terms govern how SnapMatting may be used. They explain acceptable use, what you are responsible for when uploading images, how legal complaints may be handled, and the limits of the service.
1. About the Service
SnapMatting provides browser-based image background removal and related image-processing features. The service may be free, ad-supported in the future, limited by rate controls, or updated over time.
2. Eligibility
You may use the service only if:
- You have the legal capacity to enter into a binding agreement;
- Your use complies with applicable law; and
- You are not prohibited from using the service under sanctions, export controls, or similar restrictions.
3. Your Content
You retain ownership of the images and other material you upload (“User Content”). You are responsible for ensuring that you have the rights and permissions needed to upload, process, use, and download that content.
By uploading User Content, you grant SnapMatting a limited, temporary, non-exclusive license to host, copy, process, transmit, and display that content only as reasonably necessary to provide the requested service, protect the service, and comply with law.
4. What You Must Not Upload or Do
You agree not to:
- Upload content you do not own or have permission to use;
- Upload illegal, infringing, deceptive, abusive, defamatory, or harmful content;
- Upload malware, malicious scripts, or anything intended to disrupt the service;
- Probe, scrape, attack, overload, reverse engineer, or interfere with the service;
- Circumvent rate limits, queueing, access controls, or anti-abuse protections; or
- Use the service in a way that violates privacy, publicity, copyright, trademark, or other third-party rights.
5. Output and Quality
The service may generate processed image outputs based on what you upload. Results can vary depending on image quality, subject edges, transparency, lighting, hair detail, compression artifacts, and model limitations. You are responsible for reviewing outputs before relying on them.
6. Copyright and Rights Complaints
If you believe that content submitted through SnapMatting infringes your copyright or other legal rights, contact touchfaceai@gmail.com with enough detail for us to review the issue, including your contact information, the work or right at issue, the allegedly infringing material, and the basis of your claim.
We may remove content, block access, preserve limited records, or take other reasonable steps while reviewing legal complaints or abuse reports.
7. Intellectual Property
Except for User Content and any rights you retain in your own outputs, the SnapMatting service, branding, site design, code, text, graphics, and related materials are owned by SnapMatting or its licensors and are protected by applicable intellectual property laws.
8. Future Advertising
SnapMatting may later display advertising, including advertising served by third parties such as Google. If that happens, advertising technologies may rely on cookies, local storage, or similar identifiers, and their use will be subject to the Privacy Policy and any consent requirements that apply at that time.
9. Suspension, Refusal, and Abuse Prevention
We may limit, refuse, suspend, or terminate access to the service at any time if we believe use is unlawful, abusive, infringing, technically harmful, or likely to create legal, security, or operational risk.
10. Availability
We do not guarantee that the service will always be available, uninterrupted, secure, error-free, or suitable for every workflow. Features may change, be paused, or be discontinued at any time.
11. Disclaimer of Warranties
To the maximum extent permitted by law, the service is provided on an “as is” and “as available” basis. SnapMatting disclaims all warranties, express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
12. Limitation of Liability
To the maximum extent permitted by law, SnapMatting and its operators, contractors, affiliates, service providers, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, goodwill, data, or business opportunity arising out of or related to your use of the service.
Where permitted by law, the total liability for any claim relating to the service or these Terms will not exceed the greater of (a) the amount you paid us for the service in the 12 months before the event giving rise to the claim or (b) USD $50 if you paid nothing.
13. Indemnification
You agree to defend, indemnify, and hold harmless SnapMatting and its operators, contractors, service providers, and licensors from claims, liabilities, losses, damages, and expenses arising from your User Content, your misuse of the service, your violation of these Terms, or your violation of any law or third-party right.
14. Privacy
Your use of the service is also governed by the Privacy Policy, which explains how uploaded images, limited technical metadata, cookies, and any future advertising-related information are handled.
15. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the “Last Updated” date above and provide any further notice required by law.
16. Governing Law
Unless mandatory local consumer law requires otherwise, these Terms are governed by the laws of the jurisdiction in which the operator of SnapMatting is established, without regard to conflict of law principles.
